Al Dhafra Court of First Instance ruled that a young man was required to pay a girl the sum of 78 thousand dirhams, which she transferred to him after he deceived her with a fake employment advertisement on the Internet, and demanded that she transfer the amount to his account to employ her.

The girl filed a lawsuit against the young man, demanding that he be obliged to pay her an amount of 78 thousand dirhams, with the legal interest of 12% from the date of the claim, fees and expenses, noting that she had seen on a well-known website an advertisement for jobs in one of the famous programs, and when she contacted the advertiser, the defendant asked her to transfer Several times the sums to invest in one of the platforms.

She continued that the amount she transferred from her account to the defendant’s account amounted to 78 thousand dirhams, and he was convicted of seizing the amount by fraudulent means by making the plaintiff believe that he was an employment agency.

During the hearing of the case, the plaintiff attended and the defendant did not attend.

The court explained in the merits of its ruling that what is clear in the papers is that the error under which the defendant was convicted is the same error on the basis of which the plaintiff based her filing of the present lawsuit, and thus it has made a necessary decision on the occurrence of the act that constitutes the common basis between the criminal and civil lawsuits and on the legal description of this. The action and its attribution to its actor.

Regarding the plaintiff’s request for a ruling to return the amount seized from the defendant, the court indicated that, according to the provisions of the Civil Transactions Law, “no one is permitted to take another person’s money without a legitimate reason. If he takes it, he must return it,” and what was established from the criminal ruling was that the defendant was convicted. According to what was previously explained, he seized the amounts owned by the plaintiff using fraudulent methods, and it was not proven that he returned the amounts or any part of them to her.

The court ruled to oblige the defendant to pay the amount of 78 thousand dirhams and expenses.
