A man and his wife assaulted a woman by beating and insulting her


The Al Ain Court of First Instance ruled that a man and his wife must pay 20,000 dirhams to a woman as compensation for insulting and beating her.

In the details, a woman filed a lawsuit against a man and his wife, in which she demanded that they be obliged to pay her an amount of 51 thousand dirhams, in compensation for the damages she suffered, while obligating them to pay fees and expenses and in exchange for attorney’s fees. She indicated that the first defendant assaulted her by beating her, while the defendant insulted her. The second, in a way that offends her honor and prestige, and we were convicted for that incident according to a criminal ruling.

For its part, the court explained in the merits of its ruling that what is clear from the papers is the conviction of the two defendants in the criminal case for the charge of insulting the plaintiff, in addition to the conviction of the first defendant for the charge of assaulting the plaintiff’s bodily integrity and inflicting injuries on her that were described in the medical report attached to the papers, and the act was unlawful. The project at issue in this ruling is the one on which the plaintiff relies in her present claim.

Regarding the request for compensation, the court indicated that, according to the provisions of the Civil Transactions Law, every harm to another obliges the perpetrator, even if he is not discerning, to guarantee the harm. It pointed out that what is established from reviewing the criminal ruling is the conviction of the two defendants. It explained that the physical harm and psychological pain resulting from the injuries, and what it felt The plaintiff suffered from fear, panic, and pain at the moment of the assault. She requires financial and moral compensation, in addition to the humiliation that accompanied it, which caused her moral damage.

The court ruled to oblige the first defendant to pay the plaintiff an amount of 15,000 dirhams, and to oblige the second defendant to pay the plaintiff an amount of 5,000 dirhams as stated in the reasons, and obligated them to pay fees and expenses, and rejected all other requests.
