A private school sues a parent over late fees


The Abu Dhabi Family, Civil and Administrative Claims Court ruled to oblige a guardian of students in a private school to pay the school an amount of 59 thousand and 172 dirhams in late tuition fees, while obliging him to compensate the school in the amount of 1,500 dirhams.

In detail, a private school filed a lawsuit against a guardian in which it demanded that he be obligated to pay it an amount of 59 thousand and 172 dirhams and the legal interest at 12% annually until full payment, and obliging him to pay her an amount of 3000 dirhams as compensation for the damages it suffered as a result of not paying the due amount, with Obligating him to pay fees, expenses, and an allowance for attorney’s fees, and pointed out that the defendant has children who were previously registered in the school, and he accumulated the amount of the claim, but he He refused to pay, and she provided support for her claim, which was a student registration contract at the plaintiff school, and a customer account statement.

For its part, the court explained in the merits of its ruling that what was proven from the papers, through copies of the contracts for registering the defendant’s children’s application and the statement of account submitted by the plaintiff, was the existence of sums owed by the defendant that he had not paid, and it indicated that the defendant did not appear despite his announcement. Legally, to pay the lawsuit and prove that what the plaintiff claims is incorrect, and that it is the opposite of what she stated in the lawsuit, and then she sees that his liability is occupied by that amount for the benefit of the plaintiff.

Regarding the plaintiff’s request for compensation, the court indicated that the defendant’s mistake was proven, and he caused the plaintiff material damage, represented by depriving her of benefiting from the amount in question, for which she was entitled to compensation, while the court rejected the plaintiff’s request for interest, and attributed the rejection to the fact that it did not see a reason for that. The court ruled to oblige the defendant to pay the plaintiff 59,172 dirhams, and to compensate her with 1,500 dirhams, in addition to fees and expenses. The suit.
