The victim reported in the Public Prosecution’s investigations that personal disputes arose between her and her husband, so she filed a divorce suit before the Personal Status Court in Dubai, which angered him and prompted him to send e-mails to a number of her colleagues at work. The wife said that he touched on the secrets of her private life, and dealt with them in an offensive manner, claiming to her colleagues that she had run away from home with their child, and that he had filed a criminal case against her, and challenged her behavior, claiming that she had assaulted their daughter, and that his mother had been assaulted by his wife’s family, and he attached his phone number to the message. He asked her colleagues to contact him if they wanted to know more information about her.
The accused husband said that he was summoned by the relevant police station, to ask him about the email that he sent to his wife’s colleagues, and he decided that he had sent a message containing the reasons for his request to cancel it, not that he had any objection to the victim working for the company, and he told her colleagues that she had disturbed his life and fled with their child, and that he had filed a criminal case against her. Because she assaulted their daughter, attributing his action to his desire for the company to terminate his wife’s services.
The Public Prosecution charged the accused with violating the sanctity of the victim’s private and family life, using an information technology means, and attached to the lawsuit pictures of an electronic message sent by the accused, which included news, data and information related to the victim.
The court explained in the merits of its ruling that it has the right to weigh the statements of witnesses, evaluate the circumstances, and take the testimonies whenever it is reassured by them, and indicated that the charge is established against the accused according to the victim’s testimony and his confession, which the court is reassured by.
Regarding his plea of malicious accusation due to the existence of family disputes between them, the court stated that it is an objective defense that does not require a response, as long as the judiciary implicitly benefits from convicting based on corroborative evidence.
Regarding the request for compensation for the damage submitted by the victim, she stated that the original request should be filed before the civil courts. She also decided to grant the accused a fair amount of clemency, and then ruled to fine him 5,000 dirhams, confiscate the device used, and refer the case to the competent civil court.
