The state courts witnessed several cases of this kind, as people were surprised by their in summoning to investigate them in police stations, against the backdrop of crimes of fraud, with phone numbers owned by them.
They did not help them asserting that they are not the real perpetrators, from legal responsibility, because the numbers used in the crime are owned by them.
People told «Emirates Today» that they presented phones to friends and relatives for them, after their arrival in the country, in order to help them search for work. But they were surprised by them later to take advantage of them in establishing relations and committing unacceptable behaviors.
One of them recounted that he bought a phone slice with a distinguished number for his ex -wife, as an expression of his love for him and his desire to please her. However, the wind came to what the ships did not desire … as the affection turned into a dispute and a demand for separation.
He added that he had received abuse over the phone. When he tried to include her in the case file, she denied her relationship with the segment, and she said that he was the one who sent her to himself with the intention of accusing her.
Another explained that he presented his phone segment to his friend before he left the state returning to his country, because he would not need it there. But he decided to return to the Emirates after a few months, adding that he was surprised by a complaint against him from a woman on charges of opposing over the phone.
The Ministry of the Interior warned of this behavior, stressing that “giving the person a phone segment registered in his name, to others, puts it under the legal responsibility because it will be the first party that is heading towards accusations if a crime occurs using the segment given. Thus, it will be as if he recorded a pre -recognition of the crime before it occurred, ”noting that what is issued by this number of actions contrary to the law.
She explained that “the phone number is an official identification method, such as identity and passport, and the owner of the chip must be the only one who uses it, because it is included in his personal responsibility.”
Lawyer Ali Musabeh said, “The problem of extracting phones for other people is that it is easy to commit electronic crimes, because the original actor is disguised as the owner of the number or account.”
He added: «After committing the crime, the owner of the phone or the account will be the first to ask about the criminal act, and he will be on the wanted list, although he is far from committing the crime. In this case, his personal generosity does not exempt him from legal accountability except after he proves that he did not extract the phone number or did not create the account.
He explained that «this person may have helped the original accused with extracting phone numbers, or used to distribute the numbers to unknown persons in order to obtain money. In this case, he is involved in the crime committed by the original actor, unless the opposite is proven.
Musabah advised not to give others an opportunity to commit crimes using phones or websites for not being subjected to legal accountability.
It shall be punished with imprisonment for a period of no less than six months and a fine of not less than 150 thousand dirhams and not exceeding 500 thousand dirhams, or one of these two penalties, whoever uses an information network, an electronic information system, or one of the information technology means, to attack the privacy of a person in Other than the legally authorized conditions in one of the following methods: hearing, objection, registration, transmission, broadcast or disclosure of conversations, communications, or audio or visual materials, or take pictures of others or prepare, transfer, detect, copy, and preserve images. Or publish news, electronic photos, photographs, scenes, comments, data, or information, even if they are correct and real.
It is also punished with imprisonment for a period of no less than one year and a fine of no less than 250 thousand dirhams and not exceeding one million dirhams, or by one of these two penalties, whoever benefits or is easy for others without the right to use communication services or audio or visual broadcasting channels, through the information network , Or information technology.
According to these materials, “Anyone who is easy for others to benefit from communications services and helps him to commit the crime, is a partner for him to commit it.”
Musabah adds: “The danger of this behavior lies in the occurrence of people under the penalty of criminal accountability, as some people tolerate in it as a matter of confidence or knowledge, and it is believed to be exempt from accountability in the event of a crime.”
He pointed out that «the person is exempt from legal accountability in the event that the competent authorities inform him about the use of others for the phone or the website, and that he is not the owner of the account or the phone, and he has not extracted a phone to others, and that this was done without his knowledge, with proving this.
It is punished with imprisonment and a fine of no less than 150 thousand dirhams and not exceeding 500 thousand dirhams, or one of these two penalties, each of those who circumvent the protocol address of the Internet using an imaginary address, or a title that returns to others, or by any other means, with the intention of committing a crime or preventing it from discovering it.
