The Federal Court of Fujairah ruled to oblige a contractor to pay an amount of 333,951 dirhams to two women, due to his failure to complete the agreed-upon construction work. The court relied on an engineering expert’s report, which confirmed the presence of errors and violations in implementation, in addition to receiving amounts exceeding the value of the actually completed work.
According to the ruling, the court considered that the contractor is responsible for the company’s obligations in his capacity as the owner, given that the company is a sole proprietorship that does not have an independent legal personality, which makes him personally obligated to pay its dues.
The court also obligated the contractor to pay 20 thousand dirhams, as compensation for the material and moral damages suffered by the two plaintiffs, as a result of delays and errors in implementation, in addition to a delay interest of 5% annually on the original amount from the date of the judicial claim until full payment. It also obligated the defendant to pay the lawsuit fees and expenses. Legal and attorney’s fees.
