The Al Ain Court of First Instance ruled to oblige a woman to pay another woman an amount of 150,000 dirhams, after she reneged on taking the decisive oath directed to her that she did not owe the plaintiff the amount.

In the details, a woman filed a lawsuit against another, in which she demanded that she be obligated to pay the late payments due to her from an association’s subscription amounting to 150 thousand dirhams, while obligating her to pay fees and expenses and including the ruling with expedited entry into force, and as a precaution to refer the case for investigation and hearing witnesses, noting that according to an agreement between her and the defendant. In entering an association, the latter owed an amount of 150,000 dirhams for three months’ payments, and I asked it to pay it, but it refused. She abstained without any legal justification, and provided copies of bank deposit receipts and telephone correspondence as support for her claim.

The court decided to assign an expert to enable the plaintiff to fulfill her requests and achieve the elements of the case. However, the plaintiff failed to pay the expert trust and acknowledged her inability to pay, which negated the plaintiff’s right to adhere to the decision issued to assign an expert, while the plaintiff submitted a memorandum that included a request to direct the decisive oath to the defendant in the form “I swear to God Almighty to tell the whole truth and nothing but the truth, that I did not receive from the plaintiff an amount of 150 thousand dirhams through bank transfers in exchange for entering into an association, and that My obligation is not fulfilled in favor of the plaintiff with this amount in exchange for this association, and God is a witness to what I say.”

For its part, the court explained in the merits of its ruling that the decisive oath directed by the plaintiff to the defendant fulfilled its legally stipulated conditions, and did not contain any arbitrariness or violation of the law, public order, or morals. Therefore, the court accepted that it was directed to the defendant by which it was announced, but it She did not attend, whether in person or by her legal representative, and therefore she is deemed to have reneged on her oath directed to her, and thus this oath will have settled the dispute regarding the defendant’s liability being occupied in favor of the defendant. The plaintiff claimed the amount of the claim, and the court ruled that the plaintiff’s right to adhere to the decision to appoint an expert was forfeited, and that the defendant was obligated to pay the plaintiff an amount of 150 dirhams, along with expenses, and rejected all other requests.
