The Abu Dhabi Family, Civil and Administrative Claims Court ruled that two young men were obligated to pay 67,000 dirhams to a man after they deceived him through a fake advertisement on Instagram, that they owned a car, and agreed with him to sell it for 60,000 dirhams, with the aim of seizing the amount.
In detail, a man filed a lawsuit against two young men, in which he demanded that they be obligated in solidarity to pay the amount of 60 thousand dirhams, which he transferred to them, in addition to the amount of 10 thousand dirhams, to compensate him for the loss of his earnings and the losses he suffered, and to oblige them to pay the legal fees and expenses.
He indicated that he reached an agreement with the two young men to buy the car after seeing an advertisement for its sale. He transferred a deposit and the amount of the violations, and the total amount of transfers reached 60 thousand dirhams. It later became clear to him that he had fallen victim to a scam.
The court explained that what is established in the criminal case in the charge against the defendants is that they succeeded in seizing for themselves – without right – the amount shown in the report and owned by the victim, using fraudulent means through the information system and information technology means. It indicated that the two young men communicated with the victim and convinced him that they owned the vehicle described in the report, and that it was for sale, contrary to the truth, and they supported these false allegations by placing an advertisement through the “Instagram” application.
The court indicated that the defendants subsequently asked the victim to transfer the amount to their bank account, which forced the victim to believe them and transfer the amount to their account. Through this fraudulent method, they were able to deceive the victim and force him to hand over the amount as indicated in the papers.
The court confirmed that the error upon which the defendants were convicted was the same error upon which the plaintiff relied in filing the lawsuit.
The court ruled to oblige the two joint defendants to pay the plaintiff an amount of 60,000 dirhams, and to oblige them to pay 7,000 dirhams in comprehensive compensation to the plaintiff, obligating them to pay fees and expenses, and rejecting all other requests.
