The Abu Dhabi Family, Civil and Administrative Claims Court ruled that a young man was obligated to pay his co-worker an amount of 11,500 dirhams, as compensation for his defrauding her and seizing an amount of 10,000 dirhams, in exchange for providing her brother a job in a bank.
In detail, a girl filed a lawsuit against a colleague of hers at work, demanding that he pay her an amount of 10,000 dirhams, in addition to another 10,000 dirhams in compensation for the damages he caused her, noting that he told her that he has a friend who works in a bank, and that he can Hiring her brother for an amount of 10,000 dirhams, to be paid to him before starting the recruitment procedures and personal interviews.
The plaintiff explained that because of her trust in the defendant – by virtue of a co-worker relationship – she gave him the amount he requested, adding that he asked her for an additional 2,000, and he received it. But he did not fulfill what he promised.
She added that she was able to make a settlement with him, in which he pledged to return to her the amount he received from her in monthly payments. He actually paid the first installment, but then failed to pay the rest of the amount.
The judge issued a preliminary ruling directing the plaintiff to complete the oath, and she swore it in the form: “I swear by God Almighty that I delivered to the defendant a total of 12 thousand dirhams based on an agreement between us that he would employ my brother, and that after receiving the amount he did not implement what was agreed upon, and he did not return to me any of the amount delivered to him.” Only 2000 dirhams, and his debt is still outstanding to me in the amount of 10 thousand dirhams.”
During the hearing of the case, the defendant appeared and decided that he had not received any money from the plaintiff. He said that he went with her brother to a person, and that her brother was the one who delivered the money to this person, and that he had nothing to do with the subject of the present case.
For its part, the court stated in the merits of its ruling that the defendant did not submit to the court significant evidence of the validity of what he claims, namely that he did not receive any amount from the plaintiff, and that her brother was the one who delivered the amount to the other person, indicating that it saw in the pictures of the WhatsApp conversations “Abb” attached to the plaintiff’s documents is evidence of the validity of what she claims about the amount of 10,000 dirhams being deposited by the defendant for her benefit, and this evidence of the validity of what she claims has been supplemented by the directing of the supplementary oath.
Regarding the request for compensation, the court indicated that the plaintiff deserves to be awarded compensation as a result of the defendant’s delay in paying the amount, and estimated the compensation for the plaintiff in the amount of 1,500 dirhams, and ruled to oblige the defendant to pay the plaintiff 10,000 dirhams, and 1,500 dirhams as compensation for the damages she sustained.
