Legal advice
A question came from a reader in which she said:
My ex-husband is currently asking me to return a car that he bought me as a gift during the marriage. Is he legally entitled to return the gifts he gave me? I gave him a valuable watch and I have the purchase invoice for it. Do I also have the right to ask him to return it?
Answer
Legal Advisor Dr. Youssef Al-Sharif answers:
The Emirati legislator adopted the jurisprudential opinion that a gift between spouses is considered a gift and is subject to its provisions. Among these provisions is that a gift or gift from one spouse to the other prevents its recovery as long as the donee receives it unless he returns it with his consent.
The questioner can prove that she received the car as a gift from her ex-husband, even with the testimony of witnesses, and that he withdrew it from her without her consent, taking advantage of the fact that it is still in his name. In that case, she can demand the car or return the precious watch, for example.
