The Federal Supreme Court rejected the Public Prosecution’s appeal against a ruling that imposed prison sentences, a fine, and deportation from the state on four defendants, two men and two girls, on charges of running a brothel and facilitating its practice.

The Public Prosecution had requested that the charge of human trafficking be added to the defendants, but the court confirmed in the grounds for its rejection of this request that the two defendants confessed to practicing prostitution in exchange for a sum of money, based on an agreement with the defendants, which means that there is no coercion, which denies the presence of the elements of the crime of trafficking. The Public Prosecution referred the four accused to trial, charging the first and second accused with four charges: running a house for prostitution, where they facilitated its practice, by preparing it to receive men for that matter in exchange for a fee, and facilitating for two girls, the third and fourth accused, ways to practice prostitution with unknown men in exchange for Hiring, inciting and assisting the two aforementioned defendants to commit and practice prostitution, and to commit the crime of human trafficking, by exploiting the prostitution of the two defendants and thus obtaining a financial benefit. The Criminal Court sentenced the first and second defendants to four years in prison with deportation after carrying out the sentence, and as for the third and fourth defendants to three years in prison for each of them with deportation after carrying out the sentence, and fined one of them 4,000 dirhams, and the second 20 thousand dirhams, confiscated the seized items, and closed the store along with the criminal case fees. .

The Court of Appeal ruled to amend the ruling to punish each of the first and second accused with three years in prison, upholding their deportation from the country after serving their sentences, punishing the third and fourth accused with three years in prison for the charge of habitual practice of prostitution, and punishing the third accused with a fine of 3,000 dirhams for the charge of remaining in the country. illegally, assigned to her, and the fourth defendant was punished with a fine of 10,000 dirhams for the charge of entering the country illegally. assigned to it, and upholding the ruling to deport the defendants from the state for the charge attributed to them together after carrying out their sentences, confiscation, and closing the shop.

The Public Prosecution was not satisfied with this ruling, so it appealed before the Federal Supreme Court, explaining that the ruling acquitted the first and second defendants of the charge of human trafficking stipulated in the Law on Combating Human Trafficking Crimes, which stated that “exploitation in the provisions of this article includes all forms of exploitation.” sexual intercourse or exploiting the prostitution of others,” noting that it was proven from the papers that the accused committed this crime through the court’s conviction of them for the crime of exploiting the prostitution of the accused to engage in prostitution.

The Federal Supreme Court rejected the Public Prosecution’s appeal, noting that what is proven from the papers is that the two defendants confessed to practicing prostitution in exchange for a sum of money based on an agreement with the defendants, which means that there is no coercion or enslavement, which denies the presence of the elements of the crime of human trafficking required by the legislator.
