The Al Ain Court of First Instance ruled that a young man was required to pay a girl a sum of 4,600 dirhams, in addition to compensating her in the amount of 2,000 dirhams, after he deceived her and deluded her of his ability to obtain a visit visa for her sister to register at the university.

In the details, a girl filed a lawsuit in which she demanded that a young man be obligated to pay her an amount of 4,600 dirhams, with the legal interest at 5%, while obliging him to pay compensation of 20 thousand dirhams in addition to fees and expenses. She indicated that the defendant received the claim amount from her in exchange for obtaining a visit visa for her sister. He claimed that he was an employee in one of the companies, and in this way he was able to deceive her and force her to hand over the money, which prevented her sister from traveling and the opportunity to enroll her in the university. The defendant was convicted of the incident according to a judicial ruling, while the defendant appeared and admitted that he owed the plaintiff an amount of 4,600 dirhams, and asked for a deadline of one month to pay the amount.

For its part, the court explained in the merits of its ruling that what was established from reviewing the criminal ruling was that the defendant was convicted of the charge of seizing for himself an amount of 4,600 dirhams from the plaintiff, using a fraudulent method, taking a false name and an incorrect description, and deceiving her with his ability to obtain a visit visa, and in this way he was able to Who deceived the plaintiff and forced her to hand over the amount, and the unlawful act at issue in this ruling was the one on which the plaintiff relied in her claim.

Regarding the request to return the amount, the court indicated that, according to the provisions of the Civil Transactions Law, “no one is permitted to take another person’s money without a legitimate reason. If he takes it, he must return it, and whoever receives something unlawfully must return it,” and pointed out that what is proven in the papers is the defendant’s conviction. On the charge of appropriating the amount of the claim for himself, he appeared and acknowledged that he owed the plaintiff the amount claimed, which required the plaintiff to respond to her request.

Regarding the request for compensation, the court indicated that the defendant’s mistake had caused the plaintiff damage in the form of missing the opportunity to travel for her sister, and the expenses of prosecuting the defendant, in addition to the moral damage represented in the state of fear, sadness, and regret over the loss of her money. The court ruled to oblige the defendant to pay the plaintiff An amount of 4,600 dirhams, obligating him to compensate it with an amount of 2,000 dirhams as stated in the reasons, and also obligating him to pay fees. And expenses, and all other requests were rejected.
